These Terms of Service (“Terms”) are a binding agreement between you and Hilse Team (“we”, “us”, or “our”) and govern your access to and use of the Hilse mobile application and related services (the “Service”).
1) Acceptance
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
3) Accounts
- Account info: you may provide name, username, and email address.
- Security: you are responsible for safeguarding your account and activities under it.
4) What Hilse Does
Hilse lets you create personalized chat stickers and emojis by snapping or uploading images, customizing them with cropping and text, designing layouts, and exporting sticker packs to share across multiple platforms.
5) Your Content
- You own your content: you retain ownership of photos/images/text you upload or create.
- License to operate: you grant us a limited license to host, process, and transmit your content only as needed to provide the Service and perform the actions you request.
- No face recognition: we do not perform face recognition and do not create biometric templates.
6) AI / Automated Processing
Some features may use automated processing (including machine-learning techniques) to generate or refine stickers/emojis.
- User control: you decide whether to upload images/text and whether to generate content.
- Processed on our servers: when server processing is used, uploads are processed on Hilse Team controlled servers.
- No third-party sharing for processing: we do not share uploaded images/text with third parties for this processing.
- Deletion after processing: uploaded inputs are deleted promptly after processing is completed (generally immediately after output is produced, subject to short-lived technical needs).
7) Acceptable Use
You agree not to misuse the Service. For example, you will not:
- Violate laws or regulations.
- Infringe intellectual property or other rights.
- Upload unlawful, harmful, abusive, or obscene content.
- Reverse engineer, decompile, or bypass security controls.
- Disrupt the Service (malware, scraping, or excessive automated requests).
8) Exporting and Third-Party Platforms
If you export or share sticker packs to third-party platforms, you are responsible for your content and must follow those platforms’ rules. We do not control third-party platforms and are not responsible for their acts or omissions.
9) Intellectual Property
The Service (excluding your content) is owned by Hilse Team or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes unless we explicitly permit otherwise.
10) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, USE, PROFITS, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT OR (B) USD $50.
12) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if needed to protect the Service, users, or others.
13) Changes
We may update the Service or these Terms from time to time. Continued use after changes means you agree to the updated Terms.
14) Governing Law & Binding Arbitration
These Terms are governed by the laws of Hilse Team’s principal place of business (excluding conflict-of-law rules). Disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration to the extent permitted by applicable law.
- Informal resolution first: contact us at lnywqfsuzh3467@outlook.com before starting arbitration.
- Arbitration: conducted in a mutually agreed location under commercially reasonable rules.
- Exceptions: either party may seek injunctive or equitable relief for IP misuse, or where arbitration is prohibited by law.
